Terms of Service

Welcome to Save Our Ostriches, operated by Universal Ostrich Farms (UOF), a corporation organized under the laws of British Columbia, Canada. These Terms of Service (“Agreement” or “Terms”) govern your access to and use of our website, services, donation platform, training content, and online store (the “Site”).

By visiting the Site, making a donation, subscribing to the newsletter, purchasing an item, or clicking “Donate,” “Purchase,” “Subscribe,” or “I Accept,” you agree to be legally bound by these Terms, as well as our Privacy Policy and any additional guidelines, disclaimers, or updates posted on the Site.

If you do not agree to these Terms, do not proceed or use the Site.

1. Binding Terms and Changes

Your use of the Site constitutes your acknowledgment that you have read, understood, and agreed to these Terms. UOF may update these Terms at any time without prior notice by posting changes to the Site. Changes will become effective immediately upon posting. Continued use of the Site following such changes constitutes your acceptance of the updated Terms.

2. Eligibility and Participant Agreement

To use our services, including reading content, or making a donation, you must be at least 18 years old or have the permission of a legal guardian. By becoming a participant user of the Site and accessing any materials, you confirm that you are entering into a legally binding agreement governed by these Terms.

UOF’s content is provided for informational purposes only and is continually under development. UOF reserves the right to modify or discontinue content at any time without notice.

3. Donations and E-Store Purchases

• All donations and merchandise purchases are final.
  No refunds or returns are offered on any donation or item sold through the e-store unless required by law.
• Donation and purchase transactions are processed through third-party payment providers. UOF does not store any credit card or payment information.

Descriptions of or references to third-party products, publications, or services do not constitute endorsement.

4. Intellectual Property

All content, materials, and services on the Site, including text, graphics, logos, images, videos, and trademarks, are the property of UOF or its licensors. You may not reproduce, distribute, modify, or exploit any part of the Site without written consent from UOF.

5. Limitation of Liability

You agree that UOF, its affiliates, directors, officers, employees, agents, and licensors are not liable for:

• Any indirect, incidental, special, punitive, or consequential damages.
• Any loss of profits, data, or use.
• Any unauthorized charges made by third parties to your payment method.

UOF’s total liability for any claim shall not exceed the amount you paid for the specific product or service preceding the claim.

The website is provided “as is” without warranties of any kind—express or implied—including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.

6. Term and Termination

This Agreement remains in effect from your first visit or action on the Site (such as clicking “Donate” or “Purchase”) until terminated by you or UOF. UOF reserves the right to suspend, restrict, or terminate access to the Site and its services at any time without notice.

7. No Assignment

You may not transfer or assign your rights or obligations under this Agreement to anyone else without UOF’s prior written consent.

8. No Waiver

Failure by UOF to enforce any part of these Terms does not constitute a waiver of any right or provision. A waiver is valid only if in writing and signed by UOF.

9. Severability

If any part of this Agreement is found to be invalid or unenforceable, the remainder will continue in full force and effect. The invalid provision shall be replaced with a valid one that most closely reflects the original intent.

10. Governing Law and Venue

These Terms and your use of the Site are governed by the laws of British Columbia, Canada, without regard to conflict of laws rules. You agree to submit to the exclusive jurisdiction of the courts in British Columbia for any dispute arising out of or related to this Agreement.

The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms.

11. Entire Agreement

These Terms of Service, along with our Privacy Policy and any additional policies or guidelines posted on the Site, constitute the entire agreement between you and UOF concerning the use of the Site and its services. They supersede all prior or contemporaneous communications and proposals, whether oral or written, between you and UOF.
