Background
On December 31, 2024, CFIA issued a Notice ordering Universal Ostrich Farms to cull (kill) its ostriches because some tested positive for Avian Influenza.
The farm challenged this decision by filing an application for judicial review on January 30, 2025.
On January 31, 2025, the court issued a Stay Order, meaning the culling was paused until the court reviews the case.
The CFIA appealed the Stay Order to the Federal Court of Appeal.
Current Motion (CFIA’s Request):
CFIA asked the court to clarify whether the Stay Order also prevents the Minister from using their authority under the Health of Animals Act to KILL the ostriches.
CFIA also requested an expedited hearing for the judicial review, arguing that this is a matter of public health.
The CFIA wants all of the healthy ostriches still killed without allowing any further testing other than the 2 PCR tests 50 days ago on 2 dead ostriches. They emailed us stating even if we tested negative they want the ostriches destroyed.
Court’s Decision
The judge rejected CFIA’s request for clarification, stating that the Stay Order is clear and already prevents the culling until a final decision is made. However we are nervous that they still find themselves above the current ruling.
However, the judge agreed to expedite the hearing and this will be heard in the next 10 days and we have until the end of this week to have our documents and case submitted.
We are now waiting to hear which Judge will be hearing our Judicial Review and an exact date this will be heard.
